1. Acceptance of Terms

Welcome to CashBeagle. By accessing or using our website (cashbeagle.ca), submitting an application, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and CashBeagle ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

2. Description of Service

CashBeagle operates as a loan matching platform. We provide a free service that connects potential borrowers with third-party lenders in our network. Specifically:

• We are not a lender and do not make loans or credit decisions
• We do not guarantee that you will be matched with a lender or approved for a loan
• We do not set loan terms, interest rates, fees, or repayment schedules
• All lending decisions are made solely by the lenders in our network
• We act solely as an intermediary to facilitate connections between borrowers and lenders

3. Eligibility

To use CashBeagle's services, you must:

• Be at least 18 years of age (or the age of majority in your province)
• Be a Canadian citizen or permanent resident
• Have a valid Canadian address and postal code
• Have a regular source of income
• Have an active Canadian bank account
• Provide accurate and truthful information in your application

By submitting an application, you represent and warrant that you meet these eligibility requirements.

4. User Obligations and Representations

When you use our services, you agree to:

• Provide accurate, current, and complete information in your application
• Update your information promptly if it changes
• Not misrepresent your identity, income, employment, or any other information
• Not use our services for any fraudulent or illegal purpose
• Not attempt to manipulate or abuse our matching system
• Not submit multiple applications with false or misleading information
• Comply with all applicable Canadian federal and provincial laws

You acknowledge that providing false information may result in denial of service and could constitute fraud under Canadian law.

5. How Our Service Works

When you submit an application through CashBeagle:

1. We collect information about your loan needs and financial situation
2. We use this information to match you with potential lenders in our network
3. We share your information with matched lenders who may contact you with loan offers
4. Lenders independently evaluate your application and decide whether to offer you a loan
5. If you receive offers, you may choose to accept, negotiate, or decline them
6. If you accept an offer, you enter into a direct agreement with that lender

CashBeagle is not a party to any loan agreement between you and a lender. All loan terms are determined by the lender, and you are responsible for understanding and agreeing to those terms.

6. No Guarantee of Approval

CashBeagle does not and cannot guarantee:

• That you will be matched with any lenders
• That any lender will approve your loan application
• The terms, rates, or amounts that may be offered by lenders
• The speed at which lenders will respond to your application
• That you will receive the loan amount you requested

All lending decisions are made at the sole discretion of the lenders in our network based on their individual underwriting criteria.

7. Fees and Costs

CashBeagle's Service: Our matching service is free to users. We do not charge application fees, matching fees, or any other fees to borrowers.

Lender Fees: If you accept a loan from a lender, that lender may charge interest, origination fees, late payment fees, and other costs as outlined in your loan agreement. These fees are set by the lender, not by CashBeagle. You are responsible for understanding all costs before accepting a loan.

Referral Compensation: CashBeagle may receive compensation from lenders when users accept loan offers. This does not affect the cost of your loan or the terms offered to you.

8. Privacy and Data Sharing

Your privacy is important to us. By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

• We collect personal and financial information you provide in your application
• We share this information with lenders in our network for matching purposes
• Lenders may use your information to evaluate your application and contact you
• We use industry-standard security measures to protect your information
• We do not sell your information to unrelated third parties for marketing purposes

9. Credit Checks and Credit Impact

When you submit an application through CashBeagle, we may perform a "soft" credit inquiry to match you with appropriate lenders. Soft inquiries do not affect your credit score.

However, if you proceed with a lender and formally apply for a loan, that lender may perform a "hard" credit inquiry, which may temporarily impact your credit score. Each lender has its own credit check policies, which they will disclose to you.

You authorize CashBeagle and our lending partners to obtain your credit information for the purpose of evaluating your loan application.

10. Third-Party Lenders

All lenders in our network are independent third parties. CashBeagle does not control, endorse, or assume responsibility for:

• The lending practices or policies of any lender
• The terms, rates, or fees offered by lenders
• The accuracy of information provided by lenders
• The performance or non-performance of lenders
• Any disputes between you and a lender

Your relationship with any lender is directly between you and that lender. You are responsible for reviewing and understanding all loan terms before accepting any offer.

11. Disclaimers and Limitations of Liability

No Warranties: CashBeagle's services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or secure.

Limitation of Liability: To the fullest extent permitted by law, CashBeagle shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Denial of loan applications
• Unfavorable loan terms
• Lender misconduct or failure to perform
• Loss of data or information
• Financial losses of any kind

Our total liability to you for any claims arising from your use of our services shall not exceed $100 CAD.

12. Indemnification

You agree to indemnify, defend, and hold harmless CashBeagle, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any applicable laws
• Your provision of false or misleading information
• Your relationship with any lender

13. Intellectual Property

All content on the CashBeagle website, including text, graphics, logos, images, and software, is the property of CashBeagle or its licensors and is protected by Canadian and international copyright laws.

You may not copy, reproduce, distribute, modify, or create derivative works from our content without our express written permission.

14. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in fraudulent activity.

You may stop using our services at any time. However, any information already shared with lenders cannot be recalled.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the Arbitration Act of Ontario, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and CashBeagle regarding your use of our services.
